These Terms and Conditions govern the purchase of any product and services offered by Powerlogy Electrical Store. Please read these Terms and Conditions very carefully as it contains very important information about the rights and obligations as well as limitations and exclusions that may apply to you. None of the terms and conditions herein may be modified or waived except with the written consent of an authorized officer of Powerlogy Electrical Store. By placing an order, you acknowledge you have read, accepted and agreed to be bound by these Terms and Conditions, without limitation or qualifications. Buyer waives all terms and conditions in any of Buyer’s correspondence, purchase orders or other forms which limit, extend or otherwise conflict with this agreement. These Terms and Conditions are subject to modification at any time without prior written notice and in the sole discretion of Powerlogy Electrical Store.
Powerlogy Electrical Store makes no representations or warranties of any kind, express or implied, statutory or otherwise about products or accuracy of the information contained on this website. The only warranties available to buyers shall be those provided by the manufacturer of the product.
Powerlogy Electrical Store may discontinue any product at any time without notice.
The product prices displayed on www.powerlogy.ca don’t include shipping and sales taxes, if applicable, which will be added to your total invoice price.
Products availability are subject to change without notice. There is no assurance that a particular product will be available at any given time. For more information customers are encouraged to visit our store or speak to Powerlogy Electrical Store sales representative.
Powerlogy Electrical Store shall not be liable for any loss or damage caused by any delay or failure to perform resulting in whole or in part from acts of God, severe weather conditions, labour disruptions, governmental controls, war, terrorist attack, risks, shortages, inability to procure or ship product or other inability of the manufacturer to perform, delay in transportation, Internet Service Providers or Internet backbone provider’s failure, or any circumstance beyond the actual control of Powerlogy Electrical Store in its business operations.
Powerlogy Electrical Store shall not be liable for any loss of profit, manufacturing expense, overhead, business interruption, losses, loss of customers, injury to reputation, loss of contract or orders, injury to body or mind, or any other loss caused or contributed to by the use or misuse of any product or services provided by Powerlogy Electrical Store

The parties agree to treat Quotation and Order as confidential and shall not disclose it to any third party.
Any quotation issued by Powerlogy Electrical Store is valid for a maximum period of 30 days from the date issued and in order to be binding, quotations should be in writing. No verbal quotations are valid. Quotation prices are based on quantities and/or scope shown and are subject to change if the quantity or scope changes. Products shown in stock, prior to purchase order is issued, are subject to prior sale.
Quotation by Powerlogy Electrical Store is based on the available information at the time of quotation and it is the responsibility of the buyer to approve and ensure accuracy of the product for its purposes before acceptance.
Any order placed by customer must be paid for at time of order by debit or credit card, or on delivery by cash or certified cheque or bank demand draft unless the customer has applied in writing and has approved credit with Powerlogy Electrical Store. Powerlogy Electrical Store may at its sole discretion require that full payment be executed before delivery of any product or provision of services. Payments not received when due will be subject to a late fee of 2%, or the maximum lawful rate, whichever is lower, of the outstanding invoice balance for each 30‑day period or portion thereof past due. All costs of collecting any moneys due from Customer under the terms and conditions hereof, including but not limited to, legal expenses and attorneys’ fees shall be paid by Customer to Powerlogy Electrical Store. In addition to other rights and remedies, Powerlogy Electrical Store reserves the right to withhold deliveries, shipments or cancel the purchase order, when Powerlogy Electrical Store deems itself insecure with respect to Customer’s ability to pay for the purchase order.
If product price errors are discovered on the website, we will notify you if your order includes products that are priced incorrectly and are promptly be corrected on our system
Powerlogy Electrical Store reserves the right to refuse service to any customer and/or limit the quantity on order without prior notice. Orders are not binding until accepted by Powerlogy Electrical Store as verification of information may be required prior to the acceptance of the order.
Customers are responsible to pay any provincial and federal sales taxes applied on the invoice price and Powerlogy Electrical Store must collect sales tax on sale of any product.
All products are sold "as is," and Powerlogy Electrical Store disclaims all warranties of any kind relating to the products or use thereof, express or implied, including warranties of merchantability, non-infringement, title or fitness for a particular purpose.
Buyer should inspect all shipments of products upon receipt and any discrepancies or damaged products should be notified in writing to Powerlogy Electrical Store with 24 hours of receipt of products.
Purchase Orders that have been accepted by Powerlogy Electrical Store cannot be cancelled by Customer without prior written authorization of Powerlogy Electrical Store and Customer agrees to indemnify Powerlogy Electrical Store against any loss arising from any cancellation, and to reimburse Powerlogy Electrical Store for all direct or indirect costs incurred by Powerlogy Electrical Store with respect to any cancellation. In the event, buyer cancels the project that involves custom products, special specification products, technical drawings and/or technical documentation, buyer shall be charged for the actual costs incurred prior to the receipt of the notice of termination for the project in an amount not to exceed the original quotation.
All returnable reels and spools will be billed on the same invoice as material wound thereon, as a separate item and credit in full will be given for reels and spools received in good condition by Powerlogy Electrical Store. Returnable reels and spools to be returned prepaid.
All transportation charges and related expenses shall be the responsibility of Customer unless otherwise expressly agreed to by Powerlogy Electrical Store in writing.
If any provision of these Terms and Conditions are held illegal, unenforceable or in conflict with any law by a court of competent jurisdiction or arbitral tribunal, such provision shall be deemed severed from these Terms and Conditions and the validity of the remainder of these Terms and Conditions shall not be affected thereby.
Any dispute or disagreement arising out of these Terms and Conditions, or breach thereof, shall be settled by arbitration administered by the Ontario Courts under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be held in Toronto, Ontario.
